Please read these Terms of Service ("Terms") carefully before using the Flashyr website and AI photoshoot service (the "Service"), operated by BLACK PIXEL AI INC. ("Flashyr," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

You may register for an account using your email address or via Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@flashyr.co if you suspect unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms.

3. The Service

Flashyr provides an AI-powered photoshoot service that generates professional-quality portrait photographs from selfie photos you upload. The Service includes:

  • Upload of 1–4 personal photos for AI processing.
  • Selection of photographic styles from our library.
  • Receipt of AI-generated portrait photographs within minutes.
  • Download of generated images in HD quality.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

4. User Content and License

Your Content

You retain ownership of the photos you upload to the Service ("User Content"). By uploading User Content, you grant Flashyr a limited, non-exclusive, royalty-free license to use, process, and analyze your photos solely for the purpose of generating AI images for you and improving our AI models (in anonymized, aggregated form).

Your Representations

You represent and warrant that:

  • You own or have the necessary rights to the photos you upload.
  • The photos depict yourself or individuals who have given you explicit consent to submit their likeness.
  • Your User Content does not violate any third-party rights, including privacy, publicity, or intellectual property rights.
  • Your User Content does not depict minors.

5. Generated Content and Intellectual Property

AI-generated images produced using your photos ("Generated Content") are provided to you for personal, non-commercial use. Subject to your compliance with these Terms, Flashyr grants you a non-exclusive, non-transferable license to use, download, and share Generated Content for personal purposes.

Flashyr retains all rights in the Service, including its AI models, software, design, and underlying technology. You may not reverse-engineer, copy, or commercialize the Service or any component thereof.

You may not use Generated Content to: (a) impersonate others, (b) create deepfakes for deceptive purposes, (c) violate any applicable law, or (d) generate content that is defamatory, obscene, or harmful.

6. Prohibited Uses

You agree not to use the Service to:

  • Upload photos of other individuals without their explicit consent.
  • Upload photos depicting minors (persons under 18).
  • Create content that is sexually explicit, violent, harassing, or defamatory.
  • Circumvent, disable, or interfere with security-related features of the Service.
  • Use automated scripts, bots, or scrapers to access the Service.
  • Resell, sublicense, or commercialize access to the Service or Generated Content at scale.
  • Violate any applicable local, state, national, or international law or regulation.

7. Payment Terms

Pricing

The Service currently offers a one-time payment plan. Pricing is displayed at checkout and is subject to change with reasonable notice.

Payment Processing

All payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees. You agree to Stripe's terms of service.

Refund Policy

Due to the digital nature of the Service and immediate delivery of results, all sales are final. We do not offer refunds except in the following circumstances:

  • The Service failed to deliver any generated images due to a technical error on our part.
  • You were charged incorrectly due to a billing error.

To request a refund under these circumstances, contact us at support@flashyr.co within 7 days of purchase with your order details.

Taxes

You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service.

8. Privacy

Our Privacy Policy, incorporated herein by reference, describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

AI-generated images are creative outputs and may not perfectly reflect your appearance or match all stylistic expectations. Results vary based on the quality of uploaded photos and the nature of the selected style.

10. Limitation of Liability

To the maximum extent permitted by applicable law, BLACK PIXEL AI INC. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BLACK PIXEL AI INC., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to the Service, our users, or third parties. You may delete your account at any time by contacting us at support@flashyr.co.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You waive the right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
